Guidelines for panel members on the civil standard of proof (Version 2.0)
Document description
This is one of the sets of guidelines that the Disciplinary Board has formulated about the operation of the disciplinary schemes. In disciplinary proceedings, the Faculty/Institute are required to prove to the civil service, as applied by the Courts of England and Wales, that the Respondent is guilty of misconduct. The standard of proof applied by the Courts of England and Wales in civil cases is that of the balance of probabilities. This means that the party bearing the burden of proof, i.e., the Faculty/Institute, must demonstrate that it is "more probable than not" that the Respondent is guilty of misconduct.
